Code

The German advertising industry implicitly adheres to the ICC Code and has adopted several product- and sector-specific codes. It is possible to submit complaints to the DW concerning advertising in all kinds of media.

 

Complaints handling

The DW handles both competitor and consumer complaints. (Complaints alleging misleadingness or unfair competition are transferred to the Wettbewerbszentrale). Complaints must be submitted in writing. There is no charge for complaints handling.

 

Copy advice/pre-clearance

The DW does offer a copy advice service for a fee. To be eligible for it, an advertiser or advertising agency has to become an associated member of ZAW. The DW does not carry out pre-clearance.

The Wettbewerbszentrale applies statute law relating to unfair competition.

 

Complaints handling

Complaints, stating the identity of the complainant, should be submitted in writing together with a copy of the offending advertisement or with an exact description of the unfair marketing practice. Complaints can also be submitted online, using the complaint form on the website.

 

Copy advice/pre-clearance

The Wettbewerbszentrale’s Executive Secretariat, which is staffed by lawyers, provides copy advice, free of charge, to its members. The Wettbewerbszentrale does not pre-clear advertisements.
